1. Overview

These Terms of Service (“Terms”) govern your access to and use of the services provided by InsightEd Analytics LLC (“we,” “our,” “us”), including analytics, dashboards, reporting, application development, and related consulting services. By using our services or accessing our website, you agree to these Terms.

2. Use of Services

You may use our services only for lawful purposes and in accordance with these Terms. You agree not to misuse our services, interfere with their operation, or attempt unauthorized access to our systems.

3. Client Responsibilities

Clients are responsible for:

  • Providing accurate, lawful data for analysis.

  • Ensuring they have the rights and permissions to share the data with us.

  • Complying with all applicable laws, including FERPA, CCPA/CPRA, and industry‑specific regulations.

4. Our Responsibilities

We will:

  • Provide analytics, reporting, dashboards, and related services as agreed.

  • Protect personal information in accordance with our Privacy Policy.

  • Act as a service provider under CCPA/CPRA and as a School Official under FERPA when applicable.

5. Use of Client Data for Marketing and Strategy

For business clients only, we may use aggregated, de‑identified, or non‑sensitive data to create:

  • Marketing content

  • Advertisements

  • Strategic insights

  • Case studies

  • Industry trend analyses

We will never use student data, educational records, or any FERPA‑protected information for marketing, advertising, or promotional purposes.

6. Intellectual Property

All dashboards, reports, applications, and analytics deliverables created by InsightEd Analytics LLC remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use deliverables for their internal business or educational purposes.

7. Payment and Billing

Payment terms will be outlined in individual project agreements or invoices. Failure to pay may result in suspension of services.

8. Limitation of Liability

Our services are provided “as is.” To the fullest extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages arising from the use of our services.

9. Termination

Either party may terminate services with written notice. Upon termination, we will return or delete client data in accordance with our Data Processing Agreement and Privacy Policy.

10. Changes to These Terms

We may update these Terms periodically. Continued use of our services constitutes acceptance of updated Terms.
